Your use of the Website and Services is governed by these Terms and Conditions. These Terms outline the terms upon which we provide, permit, and allow you to access and use the Website (freeroom.ae). We recommend that you print a copy of these Terms for reference as you use our Systems and Services. By continuing to use the Website, you agree to be bound by these Terms. Should you disagree with any part of these Terms, you must immediately discontinue using the Website and Services.

We may update these Terms and Conditions and will notify you of any changes by modifying the “last updated” date above. If any future changes are unacceptable, you should cease using the Systems and Services. Your continued use of the Systems and Services, now or following the posting of any changes, signifies your acceptance of these Terms and the changes made.

For companies advertising properties on our platform, additional terms may apply through an Advertising Order Form; however, these Terms and Conditions will remain in effect and should be read in conjunction with any other agreements you enter with Free Room.

These Terms of Use form a legally binding agreement between you and Free Room.

If you are using the platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to be bound by these Terms, you must discontinue your use of the platform and any associated content immediately.

Changes to these Terms of Use

We reserve the right to modify these Terms of Use at any time, with or without prior notice. The updated version of the Terms will be made available on this page, and if you are a registered user, we may notify you of significant changes via email where required by law.

We recommend reviewing these Terms of Use each time you access the platform to ensure you understand the terms and conditions that apply at that moment.

Changes to the Platform

Suspension or Withdrawal of The Platform

We do not guarantee the continuous availability of the platform or any of its content, nor do we guarantee that it will always be free of charge. We reserve the right to suspend, withdraw, or limit the availability of all or part of the platform for business, operational, or legal reasons without prior notice.

Right to Use the Platform and Content

Subject to your compliance with these Terms of Use, Free Room grants you a personal, limited, non-transferable, non-exclusive, and revocable right to access and use the platform and its content.

You may print one (1) copy or download extracts from any page on the platform for your personal, non-commercial use, and you may share content with others for informational purposes. However, you must not alter the paper or digital copies of any materials in any way, nor use any illustrations, photographs, videos, or graphics separately from the accompanying text. Commercial use of any content requires our prior written consent.

All rights, including intellectual property rights, in the platform and its content (such as designs, text, and graphics) are owned or licensed by us. These are protected by copyright laws globally, and all rights are reserved.

All trademarks, logos, trade dress, service names, and service marks (“Marks”) displayed on the platform are owned by us or third-party licensors. You are not permitted to use these Marks without prior written approval.

Platform Restrictions

You must not:

• Use the Platform if you are under eighteen (18) years of age.
• Engage in any unlawful activities or use the Platform for any unlawful purposes.
• Attempt to gain unauthorized access to the Platform, its servers, or any connected servers, databases, or computers.
• Interfere with, damage, or disrupt any part of the Platform, its content, or any equipment, software, or networks used in the provision of the Platform.
• Introduce viruses, trojans, worms, logic bombs, or any other malicious or harmful material to the Platform.
• Impersonate another person while using the Platform.
• Conduct yourself in a vulgar, offensive, harassing, or objectionable manner.
• Use the Platform to generate unsolicited advertisements or spam.
• Reproduce, duplicate, copy, sell, trade, or exploit any portion of the Platform or its content for commercial purposes.
• Use any manual methods or automated scripts, robots, ‘spiders’, ‘bots’, or ‘crawlers’ to scrape the Platform or compile its content into a database, or attempt to bypass any exclusion mechanisms we have in place.
• Reverse-engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code of the Platform or its content.

We will report any violations of these restrictions to the relevant law enforcement authorities and cooperate fully, including disclosing your identity when required.

Creation of Account

Creating an Account: While you can explore the Platform as a guest, certain features require you to create an account (“Account”). During registration, you will need to provide specific details as prompted in the account creation process.

Accurate Information: If you register for an Account, the information you provide must be accurate and up-to-date. Should any of your details become outdated, you must update them to ensure continued accuracy.

Deleting Your Account: If you wish to delete your Account, you can request this by emailing at info@freeroom.ae.

Account Responsibility: You are responsible for maintaining the confidentiality of your Account login credentials, including your password. Any activity carried out under your Account is your responsibility.

Unauthorized Access: If you suspect any unauthorized access to your Account or a breach of security, you must notify us immediately.

Privacy: All personal information provided during account creation will be handled according to our Privacy Policy.

Paid Services

From time to time, Free Room offers paid services on the platform (“Paid Services”). For example, you may opt to pay a fee to have your property listing featured more prominently in search results.

By using these Paid Services, you acknowledge and agree that:

• All fees paid for Paid Services are non-refundable under any circumstances.
• While Paid Services aim to enhance visibility, they do not guarantee the success of your listing or a specific number of inquiries.

Property Listings

The Free Room platform allows users to advertise properties for rent (each a “Listing”). Property owners or agents (the “Sellers”) can list their available properties, while users interested in renting (the “Buyers”) can contact the Sellers directly through the platform to make inquiries or offers.

If you are a Seller, you must:

• Have the legal authority to rent out the property listed.
• Be the rightful owner or authorized agent to offer the property on your Listing.
• Ensure your Listing adheres to our Acceptable Use Policy.
• Provide a complete and accurate description of the property in your Listing.
• Only advertise one property per Listing and refrain from offering multiple properties under a single post.
• Post Listings in the appropriate category and section on the platform.
• Avoid listing counterfeit or misleading properties, or those that infringe on third-party rights.
• Not act as a third-party service offering to list properties on behalf of others without authorization.
• Comply with all relevant laws and regulations governing property rentals.
• Engage with Buyers in a fair and lawful manner.

If you are a Buyer, you must:

• Ensure you have the legal right to enter into rental agreements for the properties listed.
• Conduct all interactions with Sellers honestly and in good faith.

Free Room is Not Liable for Listings

You acknowledge and agree that Free Room is not obligated to monitor, approve, or moderate Listings or their content. We are not liable for the Listings posted on the platform.

When renting a property through the platform, you are engaging directly with the user who created the Listing, without any involvement from Free Room.

Although Free Room does not take responsibility for Listings, we retain the right to monitor and remove any Listing from the platform if, in our sole discretion, it violates these Terms of Use (including the Acceptable Use Policy).

Uploading Content to The Platform

Any content you upload to the platform, including as part of a Listing, will be treated as non-confidential and non-proprietary.

While you retain ownership of your content, you grant us and other users of the platform a limited license to use, store, and copy your content, as well as distribute it and share it with third parties. Specifically, you grant us a perpetual, global, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, prepare derivative works, and display or perform that content in connection with providing the services on the platform and promoting Free Room.

You are solely responsible for securing and backing up your content.

We reserve the right to disclose your identity to any third party who claims that any content you post or upload to the platform violates their intellectual property rights or privacy.

Additionally, we reserve the right to remove any content posted or uploaded by you to the platform, with or without notice, if we determine that it does not comply with these Terms of Use.

Acceptable Use Policy

You warrant that any content you submit adheres to these standards, and you will be held responsible for any breach of this warranty. This means that you will be liable for any loss or damage we incur as a result of your failure to comply with the Acceptable Use Policy.

Processing Payments

In some cases, Free Room may collect payments through the platform, such as when you opt to purchase Paid Services.

When you provide your payment details at checkout, you authorize us (through our selected payment processor) to charge the provided payment method for the amount displayed at checkout.

We will not be held liable for any losses you experience due to insufficient funds or any issues with your payment method failing to cover the full payment value.

Our Liability to You

We do not aim to exclude or limit our liability to you in any manner that would be unlawful.

Subject to the above, our liability to you is limited as follows:

If you are using the Platform for business or commercial purposes: We provide the Platform and its content to you on an “as is” and “as available” basis. We exclude all implied conditions, warranties, representations, or other terms that may apply to the Platform or any of its content. We will not be liable for any loss or damage, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, in connection with your use of, or inability to use, the Platform, or your reliance on any content. Specifically, we will not be liable for any of the following:

(i) loss of profits, sales, business, or revenue;

(ii) business interruption;

(iii) loss of anticipated savings;

(iv) loss of business opportunity, goodwill, or reputation;

(v) loss or corruption of data;

(vi) indirect or consequential loss or damage.

If you are using the Platform for personal purposes: You acknowledge and agree that we only provide the Platform for domestic and private use. We do not guarantee the availability of the Platform, nor that it or any content will be error-free or suitable for any specific purpose. You agree not to use the Platform for any commercial or business purposes, and we bear no liability for any loss of profit, business loss, business interruption, or loss of business opportunity. If we fail to comply with these Terms of Use, we are only responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to act with reasonable care and skill.

In no event shall Free Room’s liability to you in connection with your use of the Platform or these Terms of Use exceed the greater of:

(i) the amount you paid for the Paid Service that is the subject of the relevant dispute or claim (if applicable)

 (ii) one thousand UAE Dirhams (AED 1,000).

Breach of These Terms of Use

If we determine, at our sole discretion, that you have violated any aspect of these Terms of Use, we may take appropriate action as we see fit. This may include, but is not limited to, suspending or revoking your access to the Platform or its content, closing your Account, and/or pursuing legal action against you.

Reporting Illegal or Infringing Content

Should you encounter any content on the Platform that you believe is illegal, please notify us immediately at info@freeroom.ae, providing full details of the content in question.

If you are the owner of intellectual property rights or an authorized representative acting on behalf of the rights owner and believe that any content infringes upon those rights, please inform us at info@freeroom.ae, supplying comprehensive details of the alleged infringement. We will make reasonable efforts to remove any infringing content from the Platform in a timely manner.

General Terms of Use

Links to Third-Party Sites or Content
The Platform may contain links to external websites or third-party content (including Listings) for your convenience and information. These links should not be interpreted as endorsements of those websites or any content you may access through them. We do not control the content of these third-party sites and disclaim all liability regarding them.

Rules About Linking to the Platform

You are permitted to link to any page of the Platform or specific content, provided that such linking is done fairly and legally, without harming our reputation or exploiting it. The Platform must not be framed within any other site. You must not create a link that suggests any form of association, approval, or endorsement from us where none exists. We reserve the right to revoke linking permissions at any time without notice.
